Terms of Use
These Terms of Use ("Terms") are an agreement between you and Teaghlach Tech LLC, an Oregon limited liability company ("we", "us"), the maker of the Got It, Babe app (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.
Please read sections 3, 14 and 16 carefully. Section 3 makes you responsible for getting consent before you record anyone. Section 14 requires most disputes to be settled by individual arbitration instead of in court, and it waives class actions; you can opt out within 30 days. Section 16 means you cover our costs if someone makes a claim against us because of your recordings.
1. Who can use the App
You must be at least 18 years old and able to enter a binding contract. The App is for personal, non-commercial use. You may not use it if you are barred from doing so under the laws that apply to you.
2. What the App does
The App helps you remember what matters in conversations with your partner. With consent, it records a conversation, turns it into text, writes a short summary, and can add plans to your calendar and set reminders. It also lets you search what was said, get a daily recap and see follow-up nudges.
The App is a memory aid. It is not a substitute for listening, and it is not medical, mental health, legal or relationship advice.
3. Recording and consent
Recording laws differ by place. Some places require that everyone in a conversation agree before it is recorded (for example California). Oregon requires that everyone in an in-person conversation be specifically told it is being recorded.
- You must get permission from everyone you record, every time, unless they have given you a standing OK through the App, and you must follow the recording laws that apply where you and they are.
- The App shows a "Mind if I record?" screen, plays a start and stop sound, and shows a red recording light. These help, but they do not replace your duty to get a real yes.
- If anyone says no, or changes their mind, stop recording.
- A standing OK can only be given by the person being recorded, by checking the box on the "Mind if I record?" screen you hand to them. It lasts up to 30 days, covers only that person, and can be turned off at any time in Settings. Anyone else in the conversation must still agree each time.
- Voice recognition of another person is only switched on if that person agrees on the "Can it recognize your voice?" screen. Voice profiles are kept only on your phone, and can be erased at any time in Settings.
You are solely responsible for the recordings you make and for having consent. We do not check or verify consent.
Recording without consent can be a crime. In many places, including Oregon and California, recording someone without the notice or consent the law requires can lead to criminal charges and to lawsuits against you personally. Our consent screens and indemnity (section 16) protect us; they do not protect you from those laws. If you are unsure whether you may record, don't.
4. Things you must not do
You agree not to:
- record anyone secretly, without their knowledge, or after they have said no;
- record anyone under 18 without a parent's or guardian's permission, or record in places where people expect privacy and have not agreed (for example bathrooms, medical visits, or a workplace that forbids it);
- use the App to stalk, harass, threaten, control or monitor another person, or to gather evidence against someone without their knowledge;
- use the App for any illegal purpose, or upload content you have no right to share;
- copy, change, reverse engineer, resell or interfere with the App or its services, or try to get around its limits (including making new installs to get more free use, or sharing a subscription to get past the fair-use limit);
- use the App to train or build a competing product.
We may suspend or end your use of the App if you break these rules, and we may report illegal activity to the authorities.
5. Free first talk, free trial and subscription
Free first talk. Your first recorded conversation is free, with no payment details needed. It is limited to one per device and store account.
Free trial. After your first talk, you can start a 7-day free trial of the full App. The trial includes up to 2 hours of recording, counting your first talk. One trial per store account.
Subscription. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and you are charged $9.99 per month (or $79.99 per year if you pick the yearly plan), plus any taxes, until you cancel. Prices may differ by country and are shown in the App and store before you buy.
Billing and cancelling. Purchases are made and billed through Apple's App Store or Google Play using your store account. Your subscription renews automatically at the end of each period. You can cancel any time in your App Store or Google Play subscription settings; cancelling stops future charges, and you keep access until the end of the period you paid for. Deleting the App does not cancel your subscription. Before you start a trial, the App shows the price, how often you'll be charged and how to cancel. If notifications are on, we remind you two days before your trial ends, and you can always email us for help cancelling.
Refunds. Refunds are handled by Apple or Google under their policies. We cannot issue refunds for store purchases ourselves, but you can contact us and we will help where we can.
Price changes. If the price changes, we or the store will tell you in advance, and you can cancel before the new price applies.
Fair use. A subscription includes up to 20 hours of recording per month, which is far more than everyday conversations need. Imported voice messages count toward it; typed text does not. The App tells you when you reach 80%. If you reach the limit, recording pauses until your next billing period starts. You can still read, search and ask about everything you already have. We may adjust this limit with notice under section 10, and it will never be lower than 20 hours for a period you have already paid for.
After a subscription ends. If your subscription ends or a payment fails, you can still read your existing notes, but recording and new summaries stop until you subscribe again.
6. Your content
"Your content" means your recordings, transcripts, summaries, notes, names and anything else you add to the App. Your content belongs to you.
You give us a limited permission to process your content only to run the App for you: to turn recordings into text, write summaries, create calendar events and reminders, and provide support you ask for. We do not sell your content, and we do not use it to train AI models. We do not let our service providers use it to train their models either.
- The full recording is deleted from our servers and your phone once it has been summarized. Only a few short clips of key moments stay on your phone.
- Notes, transcripts and summaries are stored on your phone, not in an account with us. Voice profiles stay on the device that made them and are not backed up.
- If you delete a talk, or use "Delete all recordings and notes", it is removed from the App. We cannot recover deleted content.
You are responsible for your content and for having the right to record and share it. Our Privacy Policy explains in detail what we collect and how we use it.
7. AI summaries can be wrong
Summaries, dates, reminders and speaker labels are produced automatically and can be incomplete or wrong. Items the App is unsure about are marked "Check this" and kept off your calendar until you approve them. Always check important dates, times and details before relying on them. We are not responsible for missed events, mistakes or misunderstandings caused by relying on what the App produces.
8. Phone permissions and other services
The App asks for your microphone, calendar, notifications and, if you choose, location, and only uses them for the features you turn on. You can change these in your phone's settings.
The App relies on other companies to work, including Apple, Google, AssemblyAI for turning speech into text, and Anthropic for summaries and answers. Their services are covered by their own terms. We are not responsible for services we do not control, but we choose providers that do not train on your data.
9. Our rights in the App
The App, its design, the name "Got It, Babe" and its logo belong to us or our licensors. We give you a personal, limited, non-transferable, revocable licence to use the App on devices you own or control, under these Terms and the store's usage rules. We keep all rights we do not expressly give you.
If you send us feedback or ideas, we may use them without owing you anything.
10. Changes to the App and these Terms
We may change, add or remove features. We may update these Terms from time to time. If a change is important, we will tell you in the App before it takes effect. If you keep using the App after the change, you accept the new Terms. If you don't agree, stop using the App and cancel your subscription.
11. Ending your use
You can stop using the App at any time by deleting it and cancelling your subscription in your store settings. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the App. If we stop offering the App while you have a paid subscription, we will tell you in advance where we can. Sections 6 (your responsibilities), 7, 9, and 12 to 16 continue after these Terms end.
12. Disclaimers
The App is provided "as is" and "as available". To the extent the law allows, we make no promises that it will always work, be error-free, capture every word, or meet your needs, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Some places do not allow these exclusions, so some may not apply to you.
13. Limits on our liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, missed events or relationship harm, arising from your use of the App. Our total liability for any claim is limited to the greater of the amount you paid us for the App in the 12 months before the claim, or $100. These limits do not apply to liability for our gross negligence, willful misconduct or fraud, or to anything else the law does not allow us to limit.
14. Disputes and arbitration
Talk to us first. If you have a problem, email us at support@teaghlachtech.com. Most issues can be fixed quickly. Both sides agree to try for 30 days to resolve a dispute informally before starting arbitration.
Arbitration. If we can't resolve it, any dispute about the App or these Terms will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either side may instead bring an individual claim in small claims court, and either side may go to court over misuse of its intellectual property. If 25 or more similar claims are filed against us by the same lawyers or in a coordinated way, they will be handled in batches under the arbitration provider's mass-arbitration rules.
No class actions. Claims may only be brought individually, not as part of a class or group action.
Opt out. You can opt out of arbitration by emailing us within 30 days of first accepting these Terms, with your name and a statement that you opt out.
15. Governing law
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. Any court case allowed under these Terms will be brought in the state or federal courts in Marion County, Oregon. If you live outside the US, you may also have rights under the laws of your country that these Terms cannot take away.
16. Indemnity
You agree to cover our costs (including reasonable lawyers' fees) if someone brings a claim against us because of your recordings, your content or your breaking these Terms or the law, including recording someone without consent.
17. Apple and Google
If you got the App from Apple's App Store:
- These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any warranty that applies, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the App.
- Apple is not responsible for any claims about the App, including product liability claims, claims that it fails to meet legal requirements, and consumer protection or privacy claims.
- Apple is not responsible for investigating or defending any claim that the App infringes someone's intellectual property.
- You confirm that you are not in a country under a US government embargo or on a US list of prohibited or restricted parties.
- You must follow any third-party terms that apply when using the App, such as your mobile carrier's terms.
- Questions, complaints or claims about the App go to us, at the contact details in section 19.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you got the App from Google Play, Google Play's terms also apply to your purchase, and Google is not responsible for the App.
18. Other terms
These Terms, with the Privacy Policy, are the whole agreement between you and us about the App. If a part is found unenforceable, the rest stays in effect. If we don't enforce a part right away, we still keep the right to. You may not transfer these Terms; we may transfer them as part of a merger or sale of our business.
